These Terms govern your access to and use of our services, provided by The Pure Propane, LLC (“we,” “our,” or “us”). By using our website, signing the Propane Sales Agreement via DocuSign, or purchasing our products, you agree to be legally bound by these Terms. If you do not agree, please refrain from using our services.
The Pure Propane, LLC acts as a contracted sales team of a broker, connecting customers with AmeriGas (our supplier) for:
Bulk propane delivery for residential, commercial, agricultural, and industrial use.
Tank installation and related services (where available).
Customer support via phone or our website.
We do not store, deliver, or transport propane directly. We reserve the right to modify or discontinue services without prior notice.
Orders are placed via phone. Payment options include:
Single Payment: Full amount due upon order confirmation to initiate delivery.
Two-Step Payment: Initial payment due upon confirmation, with final payment due before delivery (as per Propane Sales Agreement, Section 2.2).
Payments are processed securely via Stripe (PCI DSS-compliant) over the phone or through authorized card charges. We do not process payments via website or third-party links. Customers must provide accurate contact, delivery, and payment information. Only the last 4 digits of card details are recorded for reference.
Delivery begins only after full payment (single or two-step) is processed and fulfilled by AmeriGas. Estimated timelines are provided post-payment via OpenPhone text. Schedules may change due to supplier availability, weather, road conditions, or supply chain issues. The Pure Propane is not liable for delays beyond our control.
Customers must ensure tank accessibility and compliance with NFPA 58/DOT standards. Failure to ensure accessibility without notice may incur redelivery fees.
Refer to our Refund and Disputes Policy for details on cancellations and refunds:
Cancellations before dispatch may qualify for a full or partial refund of propane costs (less non-refundable facilitation fees), as outlined in Section 2.
No refunds are available after dispatch or delivery.
Refunds are processed via our billing service within 7-10 days, and confirmation will be sent via text or phone.
Two-step payment cancellations follow the same rules, with initial payments non-refundable once routing has started.
Disputes must be submitted in writing within 14 days of the transaction or delivery. Contact us via our website before initiating chargebacks to resolve issues. Unauthorized chargebacks for valid orders will be contested using call logs, receipts, and proof of delivery. Customers initiating disputes without prior communication may be denied future services or referred to collection agencies.
By using our services, you agree to:
Provide accurate and complete information.
Use our services and communication tools (e.g., OpenPhone texts) lawfully.
Not resell propane without written consent.
Comply with NFPA 58 and DOT regulations for safe storage and use. Failure to comply may result in service termination and liability.
The Pure Propane, LLC, as a broker, is not liable for:
Indirect, incidental, or consequential damages resulting from service use or delays.
Losses arising from customer misuse or non-compliance with NFPA 58/DOT standards.
Damages by AmeriGas or third-party delivery personnel. Liability is limited to the amount paid for the specific order.
All content on thepurepropane.com (text, graphics, logos, etc.) is owned by The Pure Propane, LLC. Unauthorized copying, reproduction, or distribution of any content is prohibited without written permission.
Your data is protected per our Privacy Policy at https://thepurepropane.com/privacy-policy/. This covers how your information is collected, used, and your rights under CCPA.
These Terms are governed by the laws of California. Disputes unresolved within 30 days will be resolved through binding arbitration in Monterey County, California, via the American Arbitration Association (AAA).
We may update these Terms from time to time. Updates will be posted on our website with a new Effective Date. Significant updates will be communicated via email or text. Continued use of our website and services constitutes acceptance of the changes.
You agree to indemnify, defend, and hold The Pure Propane, LLC, its officers, and agents harmless from any claims, losses, or expenses (including attorney fees) arising from your non-compliance with NFPA 58, DOT regulations, or these Terms.
